Welcome to MoldMe.com (“Website” or “Platform”), operated by Mold Me Corp (“Company”, “we”, “us”, or “our”). By accessing or using our services, you (“Creator”, “User”, or “You”) agree to these Terms of Service (“Terms” or “Agreement”). These Terms apply to all users of the Platform, including OnlyFans creators who partner with us to create, sell, and distribute custom products.
1. Acceptance of Terms
By accessing or using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms, including any modifications that may be made in the future. If you do not agree to these Terms, you may not access or use the Platform.
2. Eligibility
You must be at least 18 years of age and have a valid OnlyFans account to use our services. By using the Platform, you represent and warrant that you meet these eligibility requirements.
3. Services Provided
MoldMe provides a platform for creators to produce and sell custom products using a personal molding kit provided by MoldMe. Our services include:
– Molding kit delivery and instructions
– Product manufacturing and quality control
– E-commerce platform for sales
– Payment processing
– Customer support and logistics for order fulfillment
4. Revenue Sharing and Payments
MoldMe and the Creator will enter a Revenue Share Agreement, under which the Creator will receive a specified percentage of revenue from each sale made on the Platform. Payment terms will be governed by this agreement, with funds distributed to the Creator on a regular schedule as outlined in the agreement.
5. Creator Responsibilities
– Mold Submission: Creators agree to follow the molding kit instructions and return their completed molds promptly to MoldMe. Failure to do so may result in delays or inability to fulfill orders.
– Promotion: Creators are responsible for promoting their custom products on their social media and digital platforms, such as OnlyFans.
– Product Representation: Creators warrant that the mold they submit is authentic, accurate, and represents their personal image or likeness.
– Intellectual Property: Creators grant MoldMe a license to use the likeness and mold provided for the purpose of creating, promoting, and selling the product on the Platform.
6. MoldMe Responsibilities
– Quality Control: MoldMe is responsible for producing high-quality products based on the submitted mold and for ensuring compliance with industry standards.
– Platform Management: MoldMe will provide a secure e-commerce platform where subscribers can purchase Creator products, manage payment processing, and ensure customer support.
– Revenue Sharing and Payment: MoldMe will fulfill all financial obligations to Creators based on the Revenue Share Agreement.
7. Intellectual Property Rights
All intellectual property rights for content created by MoldMe remain the property of MoldMe. This includes but is not limited to the MoldMe name, logo, website design, and associated content. Creators retain rights to their likeness and mold submissions but grant MoldMe a non-exclusive license to use them for the purposes of product manufacturing, sales, and marketing on the Platform.
8. Privacy and Data Use
MoldMe is committed to protecting the privacy of all users. By using the Platform, you agree to our Privacy Policy, which explains how we collect, use, and share your personal information.
9. Refunds and Cancellations
Due to the nature of custom products, all sales are final, and no refunds are provided once a purchase is made. MoldMe reserves the right to cancel orders in the event of fraudulent activity or violation of these Terms.
10. Limitation of Liability
MoldMe shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the use of the Platform, products, or services provided. MoldMe’s total liability shall be limited to the amount paid by the Creator to MoldMe for services rendered.
11. Dispute Resolution
In the event of a dispute, both parties agree to attempt to resolve the matter informally by contacting each other. If an informal resolution cannot be reached, any disputes shall be resolved through binding arbitration in [Jurisdiction/Location].
12. Modification of Terms
MoldMe reserves the right to modify these Terms at any time. Changes will be posted on the Platform, and continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.
13. Termination of Service
MoldMe reserves the right to terminate or suspend any Creator’s access to the Platform at its sole discretion for violation of these Terms or any actions that may harm the reputation, security, or function of the Platform.
